SB106 was struck this morning by Senator Jones. It is offically dead
for the session
As Eric stated Senator Jones is not interested in running this type of
bill again. Also she seems willing to work with us in the future.
Good Job Everyone
Chris
Utah Representative Ronda Menloves bill HB 93 Motorcycle and Off-highway Vehicle Amendments has completed it's journey through the legislative process and will be sent to the Utah governors office for his signature. If the Governor signs HB 93 it should become law later this spring. This bill enjoyed overwhelming support in the legislature. During the process there were 6 committee/floor votes taken on the bill and only 2 Representatives ever voted against it. To see what happens with a bill during the typical legislative process see http://le.utah.gov/~2010/status/hbillsta/hb0093.htm
The bill will now be sent to Governor Gary Herbert's office to be signed. Once the bill becomes law it will:
• Require that any motorcyclist who wears a helmet and receives a ticket, be given $8.00 off the fine for that ticket, unless the ticket is for a DUI.
• For those who choose not to wear a helmet provides provides that the failure to wear protective headgear: does not constitute contributory or comparative negligence on the part of a person seeking recovery for injuries; and may not be introduced as evidence in any civil litigation on the issue of negligence, injuries, or the mitigation of damages;
The eight dollar ticket discount appears to be the first in the nation and the legal protection offered to non-helmeted riders makes Utah one of the few states to guarantee this protection by statute.
